But, I just wanna know first how long does DUI stay in a person’s record? Is five years enough for that to be removed from my boyfriend’s record?

In the state of New York (or anywhere else in the United States) being convicted of driving under the influence (DUI) is considered a very serious violation. And I don’t know anybody who are charged with this that did not see an increase on his/her auto insurance rate after the DUI citation.

Being charged guilty of alcohol or drug related driving violation normally results in license suspension. As to your question, such violation stays on a person’s driving record for a period of ten years. However, if your boyfriend is charged with DUI within that period, that would only result for additional penalties on your boyfriend’s part.

If you have uninsured motorist or underinsured motorists coverage in your auto insurance policy then you are covered. However, from what I know, Florida state law does not require its motorist to carry uninsured motorist or underinsured motorists coverage, these coverages are optional. But if you have those they would be very beneficial on your part since your claim would fall under those coverages. However, if you have collision coverage on your car insurance policy, then you don’t have to worry. You can still file that claim to your insurer. But if you don’t have neither collision nor uninsured motorist or underinsured motorists coverage, then I’m afraid that you’ve reached your dead end. I am not sure if you still have other options on how to file for auto insurance claims given your situation.

One of the reasons is that you need to be convicted first of the traffic violation before it reflects on your driving records. Once convicted, the court would report it to the Maryland Motor Vehicle Administration (MVA) to have it recorded on your driving record. Usually, this process takes about 30 days or sometimes it takes even longer.

There are some instances wherein you might also be able to qualify for a driving school to have the ticket removed from your record. If that is the case, then your car insurance company would never find about your traffic violation. Thus, it will not affect your auto insurance premium.

To avoid receiving penalties, license plates and registration card must be surrendered to the Motor Vehicle Administration in Maryland if the your insurance was cancelled or lapsed.

Because your friend was caught driving an uninsured car, she will receive the penalties like a fine of $150 for the first 30 days and $7 for each succeeding days for a lapse insurance, lose of plates and registration privileges and a restoration fee of up to $25 for the registration. Your friend will not be able to do future registration for other vehicles once the insurance violation is settled. In addition, the license plates will be confiscated effective on the day of registration suspension. Other than these, there are other fines that the court may impose.
