My girlfriend rented a car in Texas and unfortunately she was involved in an accident. It was not her fault. However, neither she nor the other party has car insurance so they decided not to report the accident. I would like to know, if she is caught by law enforcement officer for driving without car insurance what would be her penalties? We both live in Beaumont, Texas.

Driving around Texas without car insurance is not a good idea at all. The state of Texas requires that all vehicles being driven be insured. The minimum required limits are 25/50/25. This means: a minimum amount of $25,000 for every person in one accident; $50,000 to cover all persons per accident; and $25,000 to pay for incurred damages to property.

Driving without auto insurance has a fine of $175 and up to $350. This is the penalty for first time offenders. For succeeding violations however, the fine just goes up. This could be as much as $1,000. Aside from the costly fines, the license would be suspended and the vehicle would be impounded.

It is very unfortunate for both parties that they do not have auto insurance. Because with this, no one can make a claim for the damages incurred from the accident. Both parties would have to pay all expenses incurred from their own pockets. With regards to your girlfriend, since she was only renting the car, she will be asked by the car rental company to pay for the repairs and also for the lost revenue while the car is being repaired.
